Voluntary Return Form (I-826)

1) This section tells you that you have the right to see an immigration judge.

2) This tells you that you have the right to call an attorney and can have access to a list of free legal service providers.

3) You may lose certain immigration benefits if you sign a voluntary return. If you do sign, you can change your mind and instead request to see an immigration judge.

4) If you have been in the U.S. for 1 year or more without legal status and choose to return, you will be barred for 10 years (unless you obtain a waiver).

 

If you've been in the U.S for more than 180 days, but less than a year, you'll be barred for 3 years (unless you obtain a waiver). 

5) You want to see an immigration judge.

6) You want to see an immigration judge because you fear going back to your country.

8) You have to physically check this box. Some forms don't have it, but if it does have a box, the agent can't mark it for you and it can't be pre-checked by a computer.

You must inital the selection that you want.

10) YOU read "Notice of Rights & Advisals"

11) Someone else read this notice to you.

9) The ICE officer or Border Patrol agent fills out this section. This tells you the name of the officer that processed your voluntary return, what day it was processed, and what time.
